Liability
Ceramiche Sberna Snc is in no way liable for any loss or damage, whether direct or indirect, caused to the Client by the purchased products, excluding, however, the manufacturer's responsibility under law. In any case, the liability of Ceramiche Sberna Snc, for indirect or direct damage caused by the purchase of the product or, in any way connected or derived from the sale of the same and/or the purchase agreement, shall not exceed the total amount of the item.
Right to withdraw
The Client has the right to withdraw in accordance with legislative decree n. 50 dated 15/01/1992 and legislative decree n. 185 dated 22/05/1999. This right is due only to those clients who, according to the aforementioned decrees, fit the definition of "consumer", described as those persons acting without entrepreneurial or professional aims. Therefore, according to these regulations:
1. The Client, if he or she is a "consumer", may withdraw from the purchase contract and return the purchased goods without indicating the motive behind his/her decision and without any type of penalty within ten working days, calculated from the date the Client receives the merchandise;
2. Within the indicated time period, the Client must send a registered letter with acknowledgement of receipt to the offices of Ceramiche Sberna Snc. The letter can also be sent within the stipulated time period by telegram, fax or e-mail, as long as it is confirmed with a registered letter with acknowledgment of receipt mailed within the next 48 hours.;
3. The merchandise must be returned in perfect condition with all manuals an accessories using the original packing materials;
4. The direct costs for returning the goods to Ceramiche Sberna Snc will be paid by the Client if he/she decides to withdraw from the purchase contract;
5. After Ceramiche Sberna Snc receives the returned merchandise, it has 30 days to credit the Client the total sum less the original shipping costs;
6. The package containing the goods and the original invoice must be addressed to: Ceramiche Sberna Snc - Via Tiberina, 146 – 06053 Deruta (PG), Italy;
7. In all of the aforementioned cases, the client must provide the information needed to refund the cost of the returned merchandise to his/her credit card (denomination, credit card number and expiration date, as well as the name, date of birth, full address, and telephone number of the credit card holder).
Please Note:
Clients may not exercise their right to withdraw (art. 5 legislative decree 185/1999 lett. C) in the case of custom-made products, i.e. products specifically made on the express request of the Client.
If an order cannot be filled
Ceramiche Sberna Sncreserves the right to cancel an order in the case of unforeseen events, which make it impossible to fill, and it will reimburse the total cost to the Client.
Shipment & delivery
Ceramiche Sberna Snc ships on-line orders with international express couriers, which offers the maximum service guarantee for quality, customer assistance and speed of shipping.
Within ITALY
Shipped postage paid (shipping charges included with order) directly to client's home using express couriers. Insurance included.
Outside ITALY
Shipped postage paid (shipping charges included with order) using DHL, FedEx or other international carriers to all of the countries included on the destination list. Insurance included. Customs duties and taxes in the destination country are paid by client.
In the shop online, they are shown ceramics/maiolica of different shapes and decorations. If at the time of order, one or more items will not be available (in stock), they will be putted in production with a ranging waiting time for shipment from a few days until about 30-45 days.
Insurance
Ceramiche Sberna Snc insures all of its shipments to protect against product damage during transport.
Procedure for reporting shipping damage (damage/breakage):
• - If shipping damage should occur: a) for shipment with delivery within ITALY, the client must call Ceramiche Sberna Snc within 3 days of receiving the merchandise; for shipment with delivery outside ITALY, the client must call DHL's or FedEx's or other international carrier's local number in his/her country within 3 days of receiving the merchandise. The customer service representative will ask for the "DHL, FedEx or other international carrier AWB shipping number" and details about the damage;
• - The client should also contact Ceramiche Sberna Snc so we can quickly fill out the insurance paperwork;
• - Once the insurance file has been opened, the express courier DHL, FedEx or other international carrierswill be authorized to inspect the damage to the merchandise at the client's address;
• - After insurance issues have been resolved in a timely manner, Ceramiche Sberna Snc will replace the damaged items, shipping them free of charge.
Refunds and returns
Ceramiche Sberna Snc guarantees that it will replace or refund all products that are defective or mistakenly sent by the company's employees.
Statement on product quality
Since our company's artistic ceramics/majolicaware are handmade, we cannot guarantee uniform, machine-quality products. Ceramiche Sberna Snc does not consider minor differences that are a natural part of a normal, accurate and professional production of handcrafted goods as defects or damage. If a client chooses to return an item for product defect, he/she must specify the nature of the defect and its precise location. Damages resulting from the incorrect use of a product are not guaranteed. Replacements and refunds are subject to technical verification by Ceramiche Sberna Snc.
Please note
The costs for merchandise returns will be free of charge only in the cases indicated above and, especially in the case of product defect, once the item has been checked and the problem confirmed by our professional staff.
If the merchandise is returned for any other reason, shipping costs will be detracted from the Client's refund.
Procedure for defective/mistaken item returns:
• - The Client must inform the company by faxing or e-mailing a letter, including a photo if possible (in case of defect), to Ceramiche Sberna Snc (e-mail: sberna@sberna.com) indicating the date the package was received, the invoice number or the number of another sales document and, if it applies, the description and location of the defect;
• - Ceramiche Sberna Snc will provide the Client with a return authorization number (RAN/Shop), which must be included in the letter that accompanies the return. The RAN number must also be written very clearly on the external package;
• - The Client must not return the product COD. A letter specifying the reason for the return and the invoice must be included in the package with the goods;
• - Any shipments sent carriage forward and without the return authorization number (RAN/Shop), will not be accepted.
Packing Materials
Ceramiche Sberna Snc packs your order to guarantee shipment to any part of the world. The packing system used is one of the safest currently available. Items are generally packed in a sturdy cardboard box (or a wooden crate for particularly fragile items), with a special inside packing containing the items.
